Exactly. They try to pull the wool over your eyes when they say that if you do not submit to a breathalyzer that you will automatically lose your licence for a year. If it will result in a 2nd in 5 years DUI conviction, you will ALREADY lose your licence for 12 months. With a good lawyer, you can the charge dismissed which will mean you won't have that 2nd DUI on your record. The charge may be diminished to "disorderly conduct" and similar fines to those of a DUI conviction might be given, but a DUI not being on your record is always a good thing.

What I was suggesting was not that if evolution were true that other primates would not exist. I was suggesting that man is not an ape at all. We may have similar physical and social features, but there are plenty of other animals who share similar features and are not the same species. Your own opinions notwithstanding, evolution is still only a THEORY, not fact. Until it is unconditionally proven to be fact, it is not wise to consider it so. That would cloud judgment and perception regarding further research. Being so narrow minded is not the position to take when on a quest for the truth.

As basically an atheist, there are many people like me who believe that evolution is fact. I'm not so sure. Of course there is medical research which proves that viruses and diseases can morph into drug resistant strains. Our own bodies are capable of similar change through the immune system. But laying aside all the mountains of evidence provided which would prove or disprove the theory of evolution, I can only look objectively at one thing. It is theorized that man evolved from ape. If survival of the fittest is absolutely true, why are there plenty of other primates existing today? I would think they would have all been the WEAKER species and would have died off long ago.

It seems to me that debating such things is rather pointless anyway. What is to be gained from the knowledge of our origins? The disproving of divine creationism? What will be changed here and now by it's discovery? All of the research and time spent on arguing this debate would be more productive if directed at other avenues. This is why I never really debate religion with people. There is not, nor will there ever be, a sufficient amount of bedrock factual evidence to support the dogma of the majority of the religions out there. Most of them are based upon "faith", which conveniently denies the practitioner any tangible evidence to evaluate the validity of it's dogma.

if you smoke a joint in America and drive, you can be serverly fucked over, DUI.

I believe it is harder to prove in court though, and the eye flicker test is used.  I know I would rather smoke a joint, and drive , than have a glass of wine and drive, but you both drugs can be taken to the point where your ability is impaired.  personally i'm really scared of old people, after being cut off at 75 by someone's grandmother last month.

Actually, it's not hard at all to prove. They give you a blood test for marijuana. When I was arrested once, one of the charges was "DUI combo", which means driving under the influence of multiple intoxicants. They gave a breathalyzer when they pulled me over and also found weed in the car. I had left my half-smoked pipe sitting in the door handle like a stoner, lol. When I got to the jail, they gave me another breathalyzer (the official BAC level they use in court), but neglected to give me a blood test for the marijuana. My lawyer had the DUI thrown out because of that technicality. He also convinced the judge to toss out my possession charge. Instead, I was charged with disorderly conduct.

They can arrest you for DUI based on the "follow my finger" roadside sobriety test, but they can't convict you on that alone. That's why you can actually sometimes have a DUI tossed out if you refuse to ever submit to a breathalyzer test. You will lose your licence for a year for refusing to take it, but with a lawyer and the right circumstances, he can have the DUI charge dropped. For a 2nd in 5 DUI, you will lose you licence for 12 months anyway, sometimes it's better to suffer the 12 months without a licence than to not have a licence AND have to have a DUI on your record too.

i wasn't drunk, but I got a dui off .03 lastnight w/ an open container. It was with the park service, anyone else ever have to go to federal court for a dui?

Dammit man! You should count yourself VERY lucky that he didn't find the weed. That would be a huge headache for you. I'm assuming that you were arrested and taken to jail. They will usually search you again at the jail when you arrive and are logged in before putting you into the holding cell. I'm guessing that you were able to bond out before being processed into population, at that point they would've taken your clothes and given you a nice orange jumpsuit and flip-flops to wear, at which point they probably would've found the weed. I'm pretty sure that if you're caught with marijuana on federal property, it's a felony even if it is less than one ounce. Even if that isn't correct, if they find the weed at the jail, THAT would definitely make it a felony charge.

.03, LMAO!!! Yeah, the legal limit in GA is .08, but that doesn't really mean that they can't arrest you for DUI if it's lower than that. In court, they call .08 and above legally drunk. They call .05 to .08 "less safe" and can often still convict you of a DUI with that BAC level. With .03, I'd highly recommend getting a lawyer, he can probably talk to the judge during the pre-trial and have it thrown out, especially if you've never had any similar charges before. I'm guessing the reason why the officer chose to arrest you on that BAC was because of the open container and also because you were probably stoned and he could tell that you were not completely sober.
